Contact: info@persistfolio.com This license applies to the dataset files you download after purchase. By paying you accept it; the checkout page asks you to confirm that you have read it. This is the version in force on the date of your purchase. 1. WHAT YOU ARE BUYING A snapshot, not a service. The files are an analytical dataset derived by Persistfolio from public disclosure files published by the U.S. Department of Labor, Office of Foreign Labor Certification (OFLC). No updates are promised. A later year is a separate edition. 2. U.S. GOVERNMENT SOURCE MATERIAL Persistfolio claims no rights in the underlying DOL records. Nothing in this license restricts any right you have in material that is in the public domain, including the DOL files themselves. The license covers what Persistfolio added: the selection, structure, cleaning, normalization, derived fields (for example employer_id, candidate_group_id, row_role, soc2018_code_if_unique, annualized wages), the panel table, the documentation and the compilation. 3. GRANT Non-exclusive, non-transferable, worldwide, perpetual right to use, copy, analyze and make derived works from the dataset for the purposes allowed by your tier (section 8), subject to this license. 4. WHAT YOU MAY DO - Run analyses, build models, dashboards, reports, research papers, internal tools and internal lists. - Publish results, charts, summaries and short excerpts, as long as what you publish cannot substitute for the dataset or for a substantial part of it. Publishing up to 1,000 rows from the dataset is always allowed. - Keep backups and copies for your own authorized users (Business tier: people in your one legal entity; Individual tier: you). - Use aggregates (for example pay ranges by occupation and state) to inform pay-setting. The free sample is licensed separately, for evaluation only: see section 16. 5. WHAT YOU MAY NOT DO a) Resell, sublicense, share, host or otherwise redistribute the dataset, or a substantial part of it, or offer it as a data product, API or search service that substitutes for it. b) Use the dataset as the source of names, addresses, e-mail addresses or other contact data for sending unsolicited commercial messages to individuals, or join it to contact data for that purpose. Analysis and lists of companies by occupation, state or volume are allowed; contacting individuals using this dataset as the source of their contact details is not. c) Try to identify, locate or profile a natural person from the dataset, or infer the individual behind an employer name. d) Use the dataset to decide whether to hire, pay, promote, reject, insure, lend to or rent to a specific person, or as a consumer report. The dataset is not a consumer report and Persistfolio is not a consumer reporting agency; this statement does not by itself decide how any law applies to your use, so do not use the data for such decisions. e) Present the dataset as official DOL data, use the DOL seal, logo or emblem, or suggest that DOL, or any employer in the data, has reviewed, approved or endorsed it. f) Remove or alter the attribution in section 6. g) Break the law with it. 6. ATTRIBUTION Keep this attribution with any published use that shows data from the dataset: "Source data: U.S. Department of Labor, Office of Foreign Labor Certification (OFLC), Labor Condition Application disclosure data, fiscal years 2010 to 2025. Derived dataset prepared by Persistfolio. Not an official DOL product; not reviewed or endorsed by the U.S. Department of Labor." Occupation (SOC) crosswalks use the public-domain crosswalks of the U.S. Bureau of Labor Statistics (BLS); credit BLS where you publish crosswalk-based results. The dataset's files were obtained by Persistfolio from the OFLC disclosure-data pages; the file names, sizes and SHA-256 hashes are in SOURCE_INVENTORY.csv. 7. NAMES OF EMPLOYERS AND INDIVIDUALS - Employer names in the dataset come from DOL's public LCA disclosure files and are reproduced as filed, except that strings that look like identifiers (e-mail addresses, tax-id-format numbers, phone numbers, long digit runs) are replaced by [REDACTED-...] tokens. Employer FEINs, contact details, attorney and agent details, street addresses and phone numbers are not included. - Some employer names are, or contain, the name of an individual (for example sole proprietors and professional practices). A heuristic screen found about 8,500 distinct names that may look like personal names; many are false positives (businesses named after founders). The redaction does not detect personal names. We keep these names because they are part of the public record and because identifying the employer is the purpose of the dataset. - That a name is in a public record does not mean every law is satisfied by republishing or using it. You are responsible for your own use, including privacy, marketing and anti-discrimination laws that apply to you. - Correction and removal requests: write to info@persistfolio.com with the employer name and, if you can, the case number or the employer_id. We acknowledge within 5 business days and decide within 30 days. If we accept, we suppress the record in future editions by its opaque identifier (employer_id and source_key), never by listing the name, and we correct errors we cause. We keep a minimal log of requests. We cannot recall copies already delivered; if we send you a suppression notice (to the e-mail you bought with), you agree to apply it to your copies and to any published list you control, within 30 days. If you receive a request from an individual about data you hold, tell us and handle it under the law that applies to you. 8. TIERS Individual / Academic (US$149): for one named person's use for academic, research, journalistic or professional work, not for personal or household purposes. Business / Commercial (US$399): for internal use within one legal entity (including its employees and contractors working for it). Affiliates are not covered; buy a license for each legal entity. Neither tier allows redistribution. 9. LIMITATIONS OF THE DATA The documents on the product page and in the download (README, LIMITATIONS, METHODOLOGY, certification report, data dictionary) describe what the data is, how it was checked and where it is weak. They are part of what you are buying, and you accept them. Highlights: employer identity is provisional; FY2010 and FY2010-FY2015 certified/withdrawn splits rest on assumptions; eight of 29 sources do not reconcile exactly to DOL statistics; the privacy redaction is pattern-based; verification was builder QA plus AI review, with no independent human audit and no legal opinion. 10. NO WARRANTY The dataset and documents are provided "as is". Persistfolio gives no warranty of accuracy, completeness, fitness for a particular purpose or non-infringement, to the extent the law allows. Flags such as willful_violator and h1b_dependent are the filer's answers on that filing, not findings by Persistfolio or DOL; the U.S. Wage and Hour Division publishes the official willful-violator list. Employer identifiers are analytical keys, not statements about corporate identity. 11. LIABILITY To the extent the law allows, Persistfolio's total liability to you for any claim about the dataset is limited to the fee you paid for it, and Persistfolio is not liable for indirect, special or consequential loss or lost profit. Nothing in this license limits liability that cannot be limited by law, or any right you have under consumer-protection law where you live. 12. TERMINATION If you breach sections 5, 6 or 7 and do not fix it within 30 days of notice, this license ends. You then stop using and delete the dataset. Analyses, aggregates and published results you made before termination, and sections 5, 7, 10, 11 and 13, survive. 13. LAW This license is governed by the laws of British Columbia, Canada and the federal laws of Canada that apply there. For Business tier purchases, courts in British Columbia have exclusive jurisdiction. If you bought as a consumer, this does not take away your right to use the courts or consumer-protection law of the place where you live. 14. PAYMENT Payment is one-time per license. Digital goods that you have downloaded are not refundable except where the law requires or where the file does not match the published SHA-256 and size. If the download fails or the file is wrong, write to info@persistfolio.com. 15. CHANGES This version governs your purchase. Later versions apply only to later purchases. 16. FREE SAMPLE (separate download, no payment) The free sample lets you judge whether the dataset fits your use. It is a selection of difficult cases (about 37,000 case rows plus related tables), not a representative subset. What you may do: download and keep it for as long as you are evaluating; open it, query it and test your tools and methods on it; use it internally to decide whether to buy; and show up to 100 rows, with the attribution in section 6, in an evaluation write-up or screenshot. What you may not do: redistribute, post, host or share the sample files or a substantial part of them; use them to build, train or improve a product, dataset or service that you offer to others; or use them for any purpose that section 5 forbids. In particular, you may not use the sample as a source of contact data for contacting individuals, you may not try to identify, locate or profile a natural person from it, and you may not use it to decide about a specific person (section 5 b, c, d). Personal data: the sample has the same redactions as the full dataset and the same employer names (section 7), including some that are or contain an individual's name. Handle them accordingly and apply any suppression notice we send you. Nothing here gives you rights in the personal data of any individual. No warranty (section 10) and the liability terms (section 11) apply to the sample. If you buy the dataset, your license under sections 3 and 4 also covers the sample files you downloaded.
